Deferred Action for Childhood Arrivals

On June 15 2012 President Obama and the Department of Homeland Security announced a new process for undocumented people who arrived to the United States as children to access limited benefits, including a work permit and a driver’s license. The policy, called Deferred Action for Childhood Arrivals (DACA), also provides relief from deportation for qualified individuals as an “act of prosecutorial discretion.” Please note that it would have to be renewed every two years, and that you are still undocumented, as according to the United States Citizenship and Immigration Services (USCIS) this “does not grant legal status.”

Who Qualifies for DACA?

  1. Under the age of 31 as of June 15, 2012;
  2. Came to the United States before reaching your 16th birthday;
  3. Have continuously resided in the United States since June 15, 2007, up to the present time;
  4. Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;
  5. Entered without inspection (undocumented) before June 15, 2012, or your lawful immigration status (visa) expired as of June 15, 2012;
  6. Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
  7. Have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

Low Priority Cases - Sign, call and share.

URGENT: On December 2011, Reyes was stopped by a police officer who arrested him for driving without a license. Now, he faces deportation THIS WEDNESDAY. If deported, Reyes will be separated from his wife and a U.S. citizen son and daughter who need their dad.

In December of 2010, US federal agencies raided the Miami house they were staying at temporarily en route to Canada. ICE arrested these six ethnic Tamil men placed them in detention at Broward Transitional Center in Pompano Beach, Florida.  They have been detained at BTC for the past 22 months, trying to apply for asylum!  If they are deported back to Sri Lanka, they face the very real threat of being killed by the same groups who threatened them to begin with.

Victor has been detained at Broward Transitional Center since May 8th. Victor’s 13 year old US citizen daughter has fallen into deep depression and is not eating or sleeping as a result of her dad’s detention. 

UPDATE: The daughter has fallen into deep depression alongside anxiety attacks due to the recent news of her father’s Thursday deportation. Make some calls to ICE and Senator Nelson.She needs to be reunited with her dad! 

Manuel is currently being held at Jena Detention Center in Louisiana and faces deportation to a country he hasn’t been to since he was 3 years old. If deported, he will be separated from his family and his U.S. citizen wife.


On November 16th, 2007, former Governor Ted Kulongoski issued an executive order removing driving privileges. This caused an unsafe environment for all drivers in Oregon. Many undocumented residents have been deported or placed into deportation proceedings for nothing more than driving without a valid license. 

Governor Kitzhaber can change this by issuing an EXECUTIVE ORDER granting licenses to all Oregonian families.

Jose Ucelo Gonzalez is a day laborer who is facing deportation because his shady boss called the police instead of paying him for the work he completed. All charges against Jose were dropped after it became clear that the employer — who refused to pay Jose for his hard work — was the real criminal. But by then, Jose had already been transferred to immigration officials. Instead of his paycheck, he now faces the possibility of deportation and separation from his baby son.

Because ensuring meal breaks are apparently too much to ask for. AP reports: 

Gov. Jerry Brown on Sunday announced that he had vetoed legislation that would have provided overtime pay, meal breaks and other labor protections to an estimated 200,000 caregivers, nannies and house cleaners in California. […]
Advocates said the legislation, dubbed the Domestic Workers of Bill of Rights, is necessary to protect a primarily female, immigrant workforce from abuse. They were successful in persuading New York lawmakers to pass similar legislation in 2010.
Among other things, the bill would have required that live-in workers be compensated if their rest period was interrupted during an eight-hour period and eased eligibility requirements for workers’ compensation.
The California Chamber of Commerce and other business interests opposed AB889. They argued that labor laws carve out an exception for domestic workers for a reason: providing meal breaks and uninterrupted rest periods for caretakers is impractical at best and dangerous at worst.

Needless to say, this is a huge upset for the domestic workers rights community, and for the 200,000 domestic workers in the state, the majority of them immigrant women.
In his statement, Governor Jerry Brown said the bill was a “noble endeavor,” but it “raises number of unanswered questions.”
Condescending much? I’m sorry, but protecting the basic rights of workers with ensuring simple needs such as meal breaks, overtime pay and adequate places for sleeping for live-in workers isn’t as much of a “noble endeavor” as it is a matter of basic fucking decency. And considering the fact that the domestic worker industry is rife with labor violations and abuses, this really shouldn’t have been a difficult decision to make.
Ai Jen Poo of the National Domestic Workers Alliance is calling on folks to tweet at Governor Jerry Brown with how you feel about his decision. Oh, and did we mention he also vetoed the Trust Act? Good job, guy.

Imagine the possibilities if we passed comprehensive immigration reform that allowed all undocumented people to come out of the shadows! THIS IS A NO-BRAINER

Maria is a low-priority deportation, according to the Morton Memo, and should be released immediately. Tax-payers have already spent over $24,000 keeping Maria in detention. Why?
