Section 38-431.02, notice is hereby given to the members of the PHOENIX CITY COUNCIL and to the general public, that the PHOENIX CITY COUNCIL will hold a meeting open to the public on Wednesday, October 17, 2012, at 5:00 p.m. located in the City Council Chambers, 200 West Jefferson, Phoenix, Arizona.
Citizen Comment will take place immediately after adjournment or recess of the regular weekly Formal Meeting, but not earlier than 5:00 p.m. The purpose of this meeting is to allow any member of the public to comment on issues of interest or concern to them. How Obama has stealthily dismantled America’s immigration enforcement laws

The ancient Chinese practice of lingchi, the “Death of a Thousand Cuts,” best describes the manner in which the Obama administration has systematically whittled away most immigration enforcement since taking office. Over time, the rule of law has been shredded not by a single act, but by many small cuts.

A review of President Obama’s record reveals a jaw-dropping steady and stealthy dismantling of virtually every tool and resource used to identify and remove deportable aliens.

Out with the Old — Gut What Works

Immediately after taking office, the Obama administration replaced effective worksite enforcement that targeted both employers and illegal workers with meaningless paper audits and modest fines. Meanwhile, the administration refused to consider making E-Verify mandatory for all employers, even resisting efforts to permanently reauthorize it, despite hundreds of thousands of businesses voluntarily using the program.

Failing to hold employers who hire illegal aliens accountable was an early, yet clear signal that the Obama administration intended to derail all enforcement.

The administration focused their sights next on programs that helped local law enforcement identify illegal aliens.  Both the 287(g) and the Secure Communities agreements were rewritten to emphasize that only criminal aliens would be processed.  A “don’t-ask, don’t-tell” policy took effect for all other illegal aliens.

In with the New — Rewrite the Rules

In 2011, Obama’s Immigration and Customs Enforcement (ICE) Director, John Morton, issued a series of internal directives instructing agency staff to focus their efforts exclusively on removing illegal aliens with criminal records.  The administration would exercise “prosecutorial discretion” for all others. The new priorities – still in place – imply that immigration violations, in and of themselves, are inconsequential.

Squash Resistance — Sue the States

With local programs such as 287(g) and Secure Communities weakened and federal authority (to not enforce the law) broadened by way of the new internal memos, the administration had consolidated the power it needed to initiate backdoor amnesty without interference.  Attorney General Eric Holder’s Department of Justice (DOJ) became the instrument of intimidation.  States that enacted their own bills requiring local police to identify illegal aliens and turn them over to federal custody, felt the blows one after the other. The DOJ sued Arizona, South Carolina, and Utah.

Distract and Deceive

To distract attention from his actions, Obama told Americans that the border was secure and that that deportations were up.

Both were deceptions.

In official documents, DHS stated that only 44% of the border was under operational control. And while deportations had, in fact risen slightly, the increase had nothing to do with expanding enforcement by the Obama administration.  A “pipeline” of deportable cases was filled by vigorous enforcement during the last two years of the Bush administration.  Those cases carried forward and Obama took credit in his first two years.  Moreover, while deportations for violent criminal aliens had risen, all other deportations were down indicating that the Obama administration felt it could pick and choose which laws to enforce.

The Final Blow

From the beginning, President Obama knew that the public would reject amnesty legislation. However, he also knew he stood a good chance of getting it done through a strategy of piecemeal efforts, provided no one noticed.

With an election looming and special interests demanding grandiose and immediate action, in June President Obama declared unilaterally that he was using executive power to implement the DREAM Act for an untold number illegal alien “kids” who were brought here through “no fault of their own.”

During his DREAM Act speech, Obama failed to mention that his new edict allowed illegal aliens up to the age of 30 to qualify.

Then, in an interview shortly thereafter with CNN’s Wolf Blitzer, DHS Secretary Napolitano admitted that parents of illegal aliens applying for deferred action – illegal alien adults who most certainly did knowingly break the law – will not be subject to immigration enforcement.  As she said, “we have it internally set up.”

With that announcement, amnesty for illegal aliens tripled.

So much for Obama’s argument he was giving amnesty just to “kids” who were “brought here through no fault of their own.”

Obama’s Death of a Thousand Cuts has virtually gutted our country’s immigration enforcement apparatus, but the record is clear and the public must hold this president accountable. Congress has an urgent mandate to begin the work of restoring credibility to our immigration system by stopping the cuts, healing the wounds, and reinstating the rule of law.

Linda Valdez, illegal alien cheerleader of the year

If you read anything Linda Valdez writes about SB1070 you will be left misinformed and in the dark about the true facts of this legislation.  She lobbies for compassion for illegal immigrants, leaving an unfeeling heart for Arizona taxpaying citizens who feel the full impact of illegal immigration on their daily lives.

It is not an “extremist” or “mean-spirited” view or even “dehumanizing” as Valdez would have you believe to want cooperation between local and federal law enforcement agencies. SB 1070 simply dictated that Arizona “must” enforce laws against illegal presence, and The Supreme Court ruled instead that they “can,” which was always been case.

Valdez wants a bond of trust between local law enforcement and illegal immigrants, but that is counterproductive. SB 1070 was intended to abolish internal police sanctuary policies that had been preventing local law enforcement agencies from enforcing laws against illegal presence. These wrong-headed policies were created out of political correctness and to help agencies avoid lawsuits from the ACLU and their ilk. They kept these agencies out of political hot water, but perpetuated the problem of non-cooperation with Federal Authorities, thus facilitating foreign nationals living in Arizona with impunity.

Valdez leads the reader to believe that breaking immigration laws is a human right, but foreign nationals do not have a civil right to break any type of laws. Furthermore, without internal enforcement of any kind there is no hope of attrition or abatement and as a result both the scofflaw employers and illegal aliens are still enjoying the status quo of misplaced compassion.

The Supreme Court upheld a key provision of Arizona’s immigration law!

Dan Stein, president of the Federation for American Immigration Reform (FAIR), called today’s ruling by the U.S. Supreme Court upholding key provision of Arizona’s immigration enforcement law, SB 1070, “an important victory for the people of Arizona and citizens everywhere who want their jobs, tax dollars and security protected from mass illegal immigration.

“The United States Supreme Court has made it very clear that state and local governments have an important role to play in enforcing federal immigration laws. Even if the Obama administration refuses to enforce most immigration laws, states have the power to deter and discourage illegal aliens from settling or remaining within their jurisdictions,” continued Stein.

Coupled with last year’s ruling, upholding Arizona’s requirement that all employers check the employment eligibility of the people they hire using the federal E-Verify system, states now have broad latitude to carry out a policy of attrition through enforcement.

“The Supreme Court has provided state and local governments with clear guidelines of what they can do to discourage illegal immigration and assist in immigration enforcement,” said Stein. “It is now up to them to choose whether to protect the interests of illegal aliens or the interests of citizens. And, it is now up to Congress to hold the Obama administration accountable for carrying out the nation’s immigration laws in a manner that protects the interests of the American people in all 50 states.”

FAIR’s legal team is carefully reviewing today’s ruling and will issue a detailed analysis of what it will mean for the future of immigration enforcement.  MORE


The immigration bombshell: Naked lawlessness

“With respect to the notion that I can just suspend deportations [of immigrants brought here illegally as children] through executive order, that’s just not the case, because there are laws on the books that Congress has passed.”
— President Obama, March 28, 2011

Those laws remain on the books. They have not changed. Yet Obama last week suspended these very deportations — granting infinitely renewable “deferred action” with attendant work permits — thereby unilaterally rewriting the law. And doing precisely what he himself admits he is barred from doing.

Obama had tried to change the law. In late 2010, he asked Congress to pass the DREAM Act, which offered a path to citizenship for hundreds of thousands of young illegal immigrants. Congress refused.

When subsequently pressed by Hispanic groups to simply implement the law by executive action, Obama explained that it would be illegal. “Now, I know some people want me to bypass Congress and change the laws on my own. … But that’s not how our system works. That’s not how our democracy functions. That’s not how our Constitution is written.”

That was then. Now he’s gone and done it anyway. It’s obvious why. The election approaches and his margin is slipping. He needs a big Hispanic vote and this is the perfect pander. After all, who will call him on it? A supine press? Congressional Democrats? Nothing like an upcoming election to temper their Bush 43-era zeal for defending Congress’ exclusive Article I power to legislate.
With a single Homeland Security Department memo, the immigration laws no longer apply to 800,000 people. By what justification? Prosecutorial discretion, says Janet Napolitano.

This is utter nonsense. Prosecutorial discretion is the application on a case-by-case basis of considerations of extreme and extenuating circumstances. No one is going to deport, say, a 29-year-old illegal immigrant whose parents had just died in some ghastly accident and who is the sole support for a disabled younger sister and ailing granny.

That’s what prosecutorial discretion is for. The Napolitano memo is nothing of the sort. It’s the unilateral creation of a new category of persons — a class of 800,000 — who, regardless of individual circumstance, are hereby exempt from current law so long as they meet certain biographic criteria.

This is not discretion. This is a fundamental rewriting of the law.

Imagine: A Republican president submits to Congress a bill abolishing the capital gains tax. Congress rejects it. The president then orders the IRS to stop collecting capital gains taxes, and declares that anyone refusing to pay them will suffer no fine, no penalty, no sanction whatsoever. (Analogy first suggested by law professor John Yoo.)

It would be a scandal, a constitutional crisis, a cause for impeachment. Why? Because unlike, for example, war powers, this is not an area of perpetual executive-legislative territorial contention. Nor is cap-gains, like the judicial status of unlawful enemy combatants, an area where the law is silent or ambiguous. Capital gains is straightforward tax law. Just as Obama’s bombshell amnesty-by-fiat is a subversion of straightforward immigration law.

It is shameful that Congressional Democrats should be applauding such a brazen end-run. Of course it’s smart politics. It divides Republicans, rallies the Hispanic vote and pre-empts Marco Rubio’s attempt to hammer out an acceptable legislative compromise. Very clever. But, by Obama’s own admission, it is naked lawlessness.

As for policy, I sympathize with the obvious humanitarian motives of the DREAM Act. But two important considerations are overlooked in concentrating exclusively on the DREAM Act poster child, the straight-A valedictorian who rescues kittens from trees. First, offering potential illegal immigrants the prospect that, if they can successfully hide long enough, their children will one day freely enjoy the bounties of American life creates a huge incentive for yet more illegal immigration.

Second, the case for compassion and fairness is hardly as clear-cut as advertised. What about those who languish for years in godforsaken countries awaiting legal admission to America? Their scrupulousness about the law could easily cost their children the American future that illegal immigrants will have secured for theirs.

But whatever our honest and honorable disagreements about the policy, what holds us together is a shared allegiance to our constitutional order. That’s the fundamental issue here. As Obama himself argued in rejecting the executive action he has now undertaken, “America is a nation of laws, which means I, as the president, am obligated to enforce the law. I don’t have a choice about it.”

Except, apparently, when violating that solemn obligation serves his re-election needs. Story.

I’m preparing to sue the President of the United States.

You read that correctly; if President Obama signs the executive order, circumvents Congress, exceeds his Constitutional authority, and refuses to enforce immigration laws in the process, I will take him to court on behalf of the American people…and I intend to win.

By now I’m sure you’ve heard about the President’s latest outrageous circumvention of the Constitution. As a proud American, I’m angry and I bet you are, too. After all, we’re a republic, not a monarchy! In this country, the people have a voice, and I intend to make sure it’s heard at the highest levels of government—all the way up to the Supreme Court!

Will you join me in the fight to protect our rights by making a contribution of $25, $50, $100 or more to remind President Obama and the Democrats that we won’t ever be silenced from defending the Constitution?

This won’t be my first court battle against executive branch overreach. In 1999, I successfully sued then-Governor Tom Vilsack for an executive order that exceeded his authority as Iowa’s Governor. I have sought the counsel of the same constitutional lawyers this time around to examine President Obama’s executive order from every possible angle.

While the law is on our side, fighting the full force of the Obama White House is no small enterprise. The Democrats have already placed my race for re-election at the top of their target list, and I know this lawsuit will fuel their fire as they become more eager than ever to silence me. But I won’t back down. And I know you won’t either. The founders spilled blood in defense of liberty—we can spill a little sweat.

The Constitution is very clear on this issue: Congress makes laws and the President must enforce them.

Obama Betrays America With Grants of “Immunity” From Deportation & Work Permits for ILLEGALS

U.S. Customs and Border Protection, the agency charged with guarding the U.S. borders, has written a secret draft policy that would let its agents catch and release low-priority illegal immigrants rather than bring them in for processing and prosecution. The policy, which has not been signed off on, would be the latest move by the Obama administration to set new priorities for the nation’s immigration services, and would bring CBP in line with other Homeland Security Department agencies that already use such “prosecutorial discretion.” The policy was detailed in an internal memo obtained by House Judiciary Committee Chairman Lamar Smith and reviewed by The Washington Times, which confirmed the document.

According to the memo, the draft policy “provides circumstances when to pursue enforcement actions … and includes detailed discussion of several factors CBP personnel should consider when exercising discretion.” Opponents say it amounts to another “backdoor amnesty” for illegal immigrants and could give the administration a tool to pressure Border Patrol agents not to pursue some people.

“Rather than allow Border Patrol agents to do their job, the Obama administration instead would like them to roll out the welcome mat for illegal immigrants,” Mr. Smith said. “This ‘catch and release’ policy undermines border security, our immigration system, and CBP’s mission.”

President Obama has called for a broad immigration bill that would legalize most illegal immigrants, but with action in Congress unlikely, his administration has taken steps to try to rewrite enforcement priorities and shift deportation efforts away from rank-and-file illegal immigrants and toward gang members and those with extensive criminal records.

Those favoring a crackdown say that amounts to a de facto amnesty for millions of illegal immigrants, while immigrant rights groups say he is setting records for deportations and that too many illegal immigrants without extensive criminal histories are being caught.

As part of its efforts, the administration last summer announced that it would grant broad prosecutorial discretion for U.S. Customs and Immigration Enforcement (ICE), a Homeland Security agency that enforces immigration laws in the country’s interior. That policy, which lets the agency decline to prosecute or deport some illegal immigrants, has received mixed reviews. Crackdown supporters say it’s too lenient, while the immigrant advocates say it’s not applied fairly. The new draft policy detailed in the memo would apply similar rules to CBP, and the chief effect could be to give Border Patrol agents discretion not to turn over illegal immigrants for prosecution.

CBP generally operates at official points of entry and along and near the U.S. borders, with authority stretching as much as 100 miles away from an international boundary. ICE is responsible for the interior, and for most deportations..

The memo said factors agents and officers could consider would include “the alien’s immigration and criminal history; claims of family, business or property ownership, ties to the community and educational background; likelihood that the alien will be granted temporary or permanent status or other relief from removal; an alien’s age and health (both physical and mental), as well as the age and health (both physical and mental) of alien’s immediate relatives; whether the alien is in the U.S. military or is the dependent of such a service member; and the alien’s length or presence in the United States and the circumstances of his/her arrival in the United States.”

In the memo, CBP officials said the draft policy is not “administrative amnesty” and can’t grant permanent legal status. The memo said the draft policy was written by senior agency leaders.

George E. McCubbin III, president of the National Border Patrol Council, the union that represents rank-and-file agents, said he understands why Homeland Security would want to have a similar policy across its agencies, but added that telling agents to let some people go sends the wrong message. He also said the draft policy would give the administration leeway to fiddle with key yardsticks used to measure the illegal immigration problem and potential solutions.

“This gives the agency an out when they want so the numbers don’t reflect too many prosecutions or too many deportations — whatever it is that they’re looking for, this gives them, I think, another tool to manipulate the numbers,” he said. The memo pointedly warns that “no public mention” should be made of the policy in order to keep it from being subject to Freedom of Information Act requests. The memo says the policy was drafted at the behest of immigrant rights groups. Mr. McCubbin said he wished his agents had been consulted.
