According to Internet Archive's 'Terms of Use'

"[Internet Archive] is provided at no cost to you and is granted for scholarship and research purposes only. .. your use of any part of the Archive's Collections will be noncommercial"

One example is publicdomainreprints.org which is a non-profit. Internet Archive gave it permission to resell scans (as printed books), it's a service for people who want printed copies of scans. So I guess if your a non-profit ("noncommercial") you can sell scans/books (but check with IA).
